Welcome to One Caribbean Radio. By accessing or using our mobile application, website, or any related services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Services.

These Terms constitute a legally binding agreement between you and One Caribbean Radio ("we," "us," or "our"). We reserve the right to modify these Terms at any time, and such modifications will be effective immediately upon posting. Your continued use of the Services following any changes constitutes acceptance of the modified Terms.

2. Eligibility

To use our Services, you must:

• Be at least 13 years of age. If you are between 13 and 18 years old, you must have parental or guardian consent to use our Services.
• Be a resident of or located in a jurisdiction where our Services are available.
• Have the legal capacity to enter into a binding agreement.
• Not be prohibited from using the Services under applicable laws.

• Stream audio content through our authorized applications.
• Download the One Caribbean Radio mobile application on your personal device.

This license does not include any right to:

• Modify, copy, distribute, or create derivative works from our content.
• Use the Services for commercial purposes without prior written consent.
• Transfer your rights to any third party.

5. Prohibited Conduct

You agree not to engage in any of the following prohibited activities:

• Copy, reproduce, distribute, or publicly display any content from our Services without authorization.
• Modify, adapt, translate, reverse engineer, decompile, or disassemble any portion of the Services.
• Use any automated system, including bots, scrapers, or data mining tools, to access the Services.
• Circumvent, disable, or interfere with security-related features of the Services.
• Share your account credentials with others or allow unauthorized access to your account.
• Use the Services to transmit any harmful, offensive, or illegal content.
• Impersonate any person or entity or misrepresent your affiliation with any person or entity.

All content available through our Services, including but not limited to music, audio streams, graphics, logos, text, and software, is owned by One Caribbean Radio or our licensors and is protected by copyright, trademark, and other intellectual property laws.

6.2 User Content

If you submit any content to our Services (such as comments, reviews, or feedback), you grant One Caribbean Radio a worldwide, non-exclusive, royalty-free, perpetual, irrevocable license to use, reproduce, modify, distribute, and display such content in connection with our Services.

6.3 Trademarks

"One Caribbean Radio," our logo, and other marks are trademarks of One Caribbean Radio. You may not use our trademarks without prior written permission.

7. Subscription Services and Payments

7.1 Free and Premium Services

One Caribbean Radio may offer both free (ad-supported) and premium subscription services. Premium subscriptions may provide additional features such as ad-free listening, offline playback, and enhanced audio quality.

7.2 Billing

If you purchase a subscription, you agree to pay all applicable fees. Subscriptions automatically renew unless cancelled before the renewal date. You are responsible for all charges incurred under your account.

7.3 Refunds

Subscription fees are generally non-refundable except where required by applicable law or at our sole discretion.

8. Advertisements

Our free Services may include advertisements. By using the free Services, you agree to receive such advertisements as part of your experience. The frequency and type of advertisements may vary. We are not responsible for the content of third-party advertisements.

9. Privacy and Data Collection

We do not warrant that the Services will be free from viruses, malware, or other harmful components.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ONE CARIBBEAN RADIO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, including but not limited to loss of profits, data, use, or goodwill, arising out of or in connection with your use of the Services.

In no event shall our total liability exceed the greater of: (a) the amount you paid to us in the twelve (12) months preceding the claim, or (b) fifty US dollars ($50.00).

Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you.

13. Indemnification

You agree to indemnify, defend, and hold harmless One Caribbean Radio, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use of the Services.
• Your violation of these Terms.
• Your violation of any rights of another party.
• Any content you submit to the Services.

14. Termination

We may suspend or terminate your access to the Services at any time, with or without cause, and with or without notice. Upon termination:

• Your license to use the Services immediately terminates.
• You must cease all use of the Services.
• We may delete your account and any associated data.

You may terminate your account at any time by discontinuing use of the Services and deleting the application from your devices.

15. Dispute Resolution

15.1 Informal Resolution

Before initiating any formal dispute resolution, you agree to first contact us and attempt to resolve any dispute informally for at least thirty (30) days.

15.2 Binding Arbitration

If informal resolution is unsuccessful, any dispute arising out of or relating to these Terms or the Services shall be resolved through binding arbitration, except that either party may seek injunctive relief in court for intellectual property violations.

15.3 Class Action Waiver

YOU AGREE THAT ANY DISPUTES WILL BE RESOLVED ON AN INDIVIDUAL BASIS AND NOT AS PART OF ANY CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which One Caribbean Radio operates, without regard to conflict of law principles.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and One Caribbean Radio regarding the Services and supersede all prior agreements and understandings.
